Welcome to the Aria Website Privacy Policy. This Privacy Policy applies to information about you that Inova Labs, Inc. (dba Aria Health) (“Aria Health”, “us”, “we”, or “our”) may obtain when you use our website and all related web pages, hosted under the URL (Aria Website), as well as when you interact with us through our social media channels, such as Facebook, Instagram or LinkedIn (Aria Social Media). The Aria Website is operated by Aria Health.

This Privacy Policy explains how we may process information collected through the Aria Website, and how we may use and share such information. Please refer to our App privacy policy, for further information about privacy practices.

Use of the Aria Website is governed by our Terms of Use. Our servers are located in the United States, and any Personal Information you provide to us will be processed in the United States. The Aria Website is intended only for United States users.


When you use the Aria Website, we or our service providers acting on our behalf, may collect the following information to provide and improve our services to you.   

Types of Data Collected


While using the Aria Website, we may ask you to provide us with certain information that can be used to contact or identify you (“Personal Information“).  This may include, but is not limited to your:

  • Email address;
  • First name and last name;
  • Mobile device number;
  • Postal address;
  • Information that you provide through surveys and other functionality of the Aria Website;
  • If you choose to purchase products from us, we may also collect a copy of the prescription, or other healthcare-related information that allows you to legally obtain that product.

We may use your Personal Information to tailor your website experience to you (for example, by matching you with products or packages that may be of interest to you), or to follow up with you about your sales experience on the Aria Website (either to gather feedback, or to reach out to you if you do not complete your website purchase). We may also use your Personal Information to contact you or send you information, for example, to send you our newsletters, marketing or promotional materials, and other information that we think may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or the instructions provided in any email or text message we send. Finally, we may de-identify Personal Information and use it or combine it with other de-identified information, provided that such de-identification is done in accordance with applicable law.


We may also collect information that your browser sends whenever you visit the Aria Website or when you access the Aria Website by or through a mobile device  (“Usage Data“). 

This Usage Data may include information such as your computer’s Internet Protocol address (e.g., IP address), browser type, browser version, the pages of the Aria Website that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When you access the Aria Website with a mobile device, this Usage Data may include information such as the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data.


Use of Cookies and Other Tracking Mechanisms. We and our service providers use cookies, pixels, tags, and other similar tracking mechanisms to automatically collect information about browsing activity, type of device and similar information within our Services. We use this information to, for example, analyze and understand how you access, use and interact with us through our Services, as well to identify and resolve bugs and errors in our Services, and to assess, secure, protect, optimize and improve the performance of our Services.

Cookies. “Cookies” are alphanumeric identifiers we transfer to your device’s hard drive for tracking purposes. Some cookies allow us to make it easier for you to navigate our Service, while others are used to enable and optimize certain Service functions, support the security and performance of the Service, or allow us to track activity and usage data within our Service.

Pixel Tags. Pixel tags (sometime called web beacons or clear GIFs) are tiny graphics with a unique identifier, similar in function to cookies. While cookies are stored locally on your device, pixel tags are embedded invisibly within web pages and online content. We may use these, in connection with our Service to, among other things, track the activities of users, and help us manage content and compile usage statistics. We may also use these in our emails to let us know when they have been opened or forwarded, so we can track response rates and gauge the effectiveness of our communications.

Third-Party Analytics and Tools. We use third party tools, such as Google Analytics, which are operated by third party companies. These third-party analytics companies may collect usage data (using cookies, pixels and similar tools) about our Services in order to provide us with reports and metrics that help us evaluate usage of our Services, improve our Sites, and enhance performance and user experiences. Do Not Track. Please note that our Services do not recognize or respond to any signal, which your browser might transmit through the so-called “Do Not Track” feature your browser might have. However, you can set your preferences for cookies on our websites as discussed below.


We may obtain information from other sources and combine that with information we collect through the Aria Website. For example, we may collect Personal Information from our commerce partner. The categories of information we collect from other sources include: 

Identifiers, such as your name, phone number, shipping address, and email address. 


The Aria Website may allow you to engage with social media services, such as LinkedIn, Facebook and Instagram (“Social Networks”), and widgets such as a “Share this” button or Social Media timeline that run on our Website or which link from Social Networks to our Website (“Social Functions”). These Social Functions may access, collect, and integrate with your Social Network accounts and information. For example, these Social Functions may collect your IP address, identify which page you are visiting on our website, or set a cookie. If you choose to use these Social Functions, you may be sharing certain Social Network profile elements with us, including your name, birthday (month/day), comments, contacts, email address, or photos. This sharing is subject to each Social Network’s own privacy policy and terms of use. We do not control those Social Networks or your profiles on those services. Additionally, from time to time, we may post Aria Social Media content on Social Networks, or may invite the public to interact with Aria Social Media (for example, through the use of a certain hashtag). You agree that if you interact with Aria Social Media, you give us permission to use that interaction in further Aria Social Media on the same Social Network (for example, by replying to your post, or reposting it on Aria Social Media). We will not use your interactions with Aria Social Media in other Social Networks or for other purposes outside of Social Media, without your consent. 

How We May Use Personal Information

We may use Personal Information we obtain through the Aria Website for various purposes, including to: 

  • Provide and maintain the Aria Website.
  • Notify you about changes to the Aria Website.
  • Allow you to participate in interactive features of the Aria Website when you choose to do so.
  • Provide customer support.
  • Gather analysis or valuable information so that we can improve the Aria Website.
  • Monitor the usage of the Aria Website.
  • Detect, prevent and address technical issues.
  • Assist with our marketing purposes, such as providing you with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or inquired about, or for more general purposes, such as identifying other potential customers that are similar to you, unless you have opted not to participate in such activities.

How We May Disclose Personal Information

We may share Personal Information for the purposes described below.  


We may share Personal Information with service providers, who will process it on behalf of us for the purposes described in this Privacy Policy and our Terms of Use (“Service Providers”). Service Providers include, but are not limited to, IT service providers, e-commerce platform hosting services, banks, credit card companies, brokers, suppliers of Durable Medical Equipment, shipping and logistics providers, training providers, survey service providers, investigators, and data hosting providers and custodians.

We are a wholly-owned subsidiary of ResMed, Inc. To facilitate our business operations, and to support the services that we provide, including the Aria Website, we may also share Personal Information with ResMed, Inc. or other companies that are members of the ResMed group. 

These Service Providers have access to your Personal Information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose. 

Google Ads (AdWords) 

Google Ads (AdWords) remarketing service is provided by Google Inc.

You can opt-out of Google Analytics for Display Advertising and customize the Google Display Network ads by visiting the Google Ads Settings page:

We may provide paid products and/or services within the Aria Website. To support this activity we use service providers for payment processing (e.g. payment processors).  
Information we provide directly to our payment processors is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information.

We may offer assistance with making a purchase through the Aria Website. If you choose to make use of such assistance, our customer service team will have access to your credit card information. We follow industry best practices when handling card information.


We may share your information in connection with, or during negotiations of, any proposed or actual merger, purchase, sale, or any other type of acquisition or business combination of all or any portion of our assets, or transfer of all or a portion of our business to another company.

Disclosure for Law Enforcement

We may share your Personal Information as required or permitted by law, including sharing with law enforcement, government agencies, or authorized third parties in response to a verified request relating to a criminal investigation or alleged illegal activity or any other activity that may expose us, you, or any other party to legal liability.

Legal Requirements

Aria Health may disclose your Personal Information in the good faith belief that such action is necessary to:  

  • Comply with a legal obligation.
  • Enforce this Privacy Policy or our Terms of Use.
  • Protect and defend the rights or property of Aria Health.
  • Prevent or investigate possible wrongdoing in connection with the Aria Website.
  • Protect the personal safety of users of the Aria Website or the public.
  • Protect against legal liability.

Your Choices

If you do not wish to receive marketing emails from us or do not otherwise want your information to be used for marketing purposes, you can opt out by following the instructions provided in the marketing emails, or by otherwise contacting us at Opting out of marketing will not affect our administrative emails to you (e.g., emails about your transactions or policy changes). 

If you no longer want to provide us information through the Aria App, you may uninstall the Aria App from your device.

Do Not Track Signals

Some web browsers or smartphones have the ability to set “Do Not Track” requests to block user activity from being tracked across web pages or devices. The Aria Website does not recognize “Do Not Track” browser signals.

California Privacy Rights

This section of the Privacy Notice provides additional information for California residents pursuant to the California Consumer Privacy Act, as amended by the California Privacy Rights Act (the “CCPA”). This section applies to “personal information” as defined in the CCPA, whether collected online or offline. This section does not address or apply to our handling of personal information that is exempt under the CCPA, such as publicly available information, information governed by the Health Insurance Portability and Accountability Act (“HIPAA”), or de-identified or aggregated information.

Our collection, use and disclosure of your Personal Information varies depending on our interactions or relationship with you. Personal Information We Collect

The following describes the categories and examples of Personal Information we may have collected about you in the last 12 months:

  • Identifiers. Such as real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, phone number, or other similar identifiers.
  • Characteristics of Protection Classifications. Such as age, gender, and medical information.
  • Commercial Information. Includes records of personal property, products or services purchased, obtained, or considered, or other purchasing or use histories or tendencies. This may include demographic information that we receive from other sources in order to better understand and reach our customers.

Including, but not limited to, browsing history, clickstream data, search history, and information regarding interactions with our Website, applications, or advertisements, including other usage data related to your use of any of our Services or other online services. 
  • Professional or Employment Related Information. Such as job title, or employment.
  • Audio, Electric, Visual, or Similar Information. Includes audio, electronic, visual, or similar information, photographs and images (e.g., that you provide us, call recordings (e.g., of customer support calls), and other visual or similar information you provide via our Services.
  • Inferences. Such as inferences drawn from any of the information described in this section about a consumer including inferences reflecting the consumer’s preferences, characteristics, behavior and abilities.

We generally collect Personal Information from the following sources:

  • Directly or indirectly from you;
  • Our affiliates and subsidiaries;
  • Our business partners;
  • Social networks;
  • Internet service providers;
  • Operating systems and platforms; and
  • Our vendors and service providers.

Retention of Personal Information

We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Notice, to comply with our tax, accounting, and recordkeeping obligations, to provide you services, for our own business purposes, and for research, development, and safety purposes. We also retain personal information for an additional time as needed to protect, defend or establish our rights, defend against potential claim, and to comply with our legal obligations. From time to time, we may also de-identify, or aggregate your personal information, retain, and use it for a business purpose in compliance with CCPA.

Purposes for Collecting and Disclosing Personal Information

We use your Personal Information for the following purposes, as more fully described in the “How We Use Personal Information” section above:

  • Communicate with you;
  • Marketing and promotions;
  • Customization and personalization;
  • Research and development;
  • Surveys and feedback;
  • Promotions and contents;
  • Planning and managing events;

  • Compliance and legal process;

Sharing personal information with third parties and other recipients

We may share your Personal Information with the following third parties and other recipients as more fully described in the “How We May Disclose Personal Information” section above:
  • Affiliates, subsidiaries, and business partners;
  • Vendors and service providers;
  • Marketing and analytics providers;
  • Regulatory and government entities, including law enforcement; and
  • Other parties with your consent.
Additionally, CCPA defines a “sale” as disclosing or making available to a third-party personal information in exchange for monetary or other valuable consideration, and “sharing” broadly includes disclosing or making available personal information to a third party for purposes of cross-context behavioral advertising. While we do not “sell” personal information to third parties in exchange for monetary compensation, we may “share” the following categories of personal information for advertising purposes: Identifiers, and Internet or Other electronic network activity information to third-party advertising networks, analytics providers, and social networks for purposes of marketing and advertising for products and services we believe may be of interest to you. We do not sell or share sensitive personal information, including mobile information, nor do we sell or share any personal information about individuals who we know are under sixteen (16) years old. Rights Regarding Your Personal Information

The CCPA provides California residents with certain rights regarding Personal Information. This section describes those rights and how to exercise them. California residents can make CCPA requests up to twice year and subject to certain exceptions and carveouts. CCPA provides the following rights:

Right to Know/Request Access. With respect to the Personal Information we have collected about you in the prior twelve (12) months, you have the right to request:

  • The categories of Personal Information we collected about you;
  • The categories of sources from which we collected your Personal Information;
  • The business or commercial purposes for collecting, selling, or sharing your Personal Information;
  • The categories of third parties to whom we have disclosed your Personal Information; and
  • The specific pieces of your Personal Information we have collected.

Right to Delete. Subject to certain conditions and exceptions, you have the right to request we delete your Personal Information.

Right to Correct. Subject to certain conditions and exceptions, you have the right to request that we correct inaccuracies in your Personal Information.

Right to Opt-Out of Sales and Sharing. You have the right to opt-out of “sharing” of your personal information, as those terms are defined under the CCPA. While we do not “sell” personal information to third parties in exchange for monetary compensation, we may “share,” the following categories of personal information for advertising purposes: identifiers, and internet or other electronic network activity information to third-party advertising networks, analytics providers, and social networks for purposes of marketing and advertising for products and services we believe may be of interest to you. We do not sell or share sensitive personal information, nor do we sell or share any personal information about individuals who we know are under sixteen (16) years old.

California recognizes the universal opt-out signal or Global Privacy Control (“GPC”). The GPC is a proposed specification (e.g., a browser setting) that allows you to make a single opt-out of the sale or share of your personal information to the extent that a particular website and browser are able to recognize the signal. You need to review privacy policy and terms of service. At Aria Health, we honor the GPC as a valid request to opt-out of the sale or share of your personal information. Right to Non-Discrimination. We will not discriminate against you for exercising any of the rights described in this section.

Authorized Agents

You may designate someone as an authorized agent to submit requests and act on your behalf. Authorized agents will be required to provide proof of their authorization in their first communication with us, and we may also require that the relevant consumer directly verify their identity and the authority of the authorized agent.

Businesses operating as an authorized agent on behalf of a California resident must provide both of the following:

  • Certificate of good standing with its state of organization; and
  • A written authorization document, signed by the California resident, containing the California resident’s name, address, telephone number, and valid email address, and expressly authorizing the business to act on behalf of the California resident.

Individuals operating as an authorized agent on behalf of a California resident must provide either of the following:

  • A notarized power of attorney signed and dated by the California resident naming the authorized agent as the California resident’s representative; or
  • A written authorization document, signed by the California resident, containing the California resident’s name, address, telephone number, and valid email address, and expressly authorizing the individual to act on behalf of the California resident.

We reserve the right to reject:

  • Authorized agents who have not fulfilled the above requirements, or
  • Automated CCPA requests where we have reason to believe the security of the requestor’s Personal Information may be at risk.

Exercising Your Rights

If you are a California resident and would like to exercise your CCPA rights, you may do so by:

Verification. Before responding to your request, we must first verify your identity using the Personal Information you recently provided to us. You must provide us with your name and email address. We will take steps to verify your request by matching the information provided by you with the information we have in our records. In some cases, we may request additional information in order to verify your identity, or where necessary to process your request. If we are unable to verify your identity after a good faith attempt, we may deny the request and, if so, will explain the basis for the denial.

Response Timing and Format. We will acknowledge receipt of your privacy request within ten (10) days. We endeavor to substantively respond to your request within forty-five (45) days of receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. If we cannot respond to your request, either fully or partially, we will also explain our reasons. For data access requests, we will deliver the data in a readily, useable format. Where permitted under the CCPA, we may charge you a reasonable fee to process your request.

California “Shine the Light” law. California Civil Code Section 1798.83, also known as California’s “Shine the Light” law, permits residents of California to request certain details about information we may disclose to third parties for direct marketing purposes. Children’s Privacy

Our Service is not available for anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. We may update our Privacy Policy from time to time. While we may not notify you in the event of every change that we make, we will notify you of any material changes to the terms of our Privacy Policy by posting a notice of those changes on the Aria Website.
