Welcome to the Aria Website Privacy Policy. This Privacy Policy applies to information about you that Inova Labs, Inc. (dba Aria Health) (“Aria Health”, “us”, “we”, or “our”) may obtain when you use our website and all related web pages, hosted under the URL (Aria Website), as well as when you interact with us through our social media channels, such as Facebook, Instagram or LinkedIn (Aria Social Media). The Aria Website is operated by Aria Health.

This Privacy Policy explains how we may process information collected through the Aria Website, and how we may use and share such information. Please refer to our App privacy policy, for further information about privacy practices.

Use of the Aria Website is governed by our Terms of Use. Our servers are located in the United States, and any Personal Information you provide to us will be processed in the United States. The Aria Website is intended only for United States users.


When you use the Aria Website, we or our service providers acting on our behalf, may collect the following information to provide and improve our services to you.

Types of Data Collected


While using the Aria Website, we may ask you to provide us with certain information that can be used to contact or identify you (“Personal Information”). This may include, but is not limited to your:

Email address;
First name and last name;
Mobile device number;
Postal address;
Information that you provide through surveys and other functionality of the Aria Website;
If you choose to purchase products from us, we may also collect a copy of the prescription that allows you to legally obtain that product.

We may use your Personal Information to tailor your website experience to you (for example, by matching you with products or packages that may be of interest to you), or to follow up with you about your sales experience on the Aria Website (either to gather feedback, or to reach out to you if you do not complete your website purchase). We may also collect information that your browser sends whenever you visit the Aria Website or when you access the Aria Website by or through a mobile device (“Usage Data”).

This Usage Data may include information such as your computer’s Internet Protocol address (e.g., IP address), browser type, browser version, the pages of the Aria Website that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When you access the Aria Website with a mobile device, this Usage Data may include information such as the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data.


In addition to information you submit through the Aria Website, we may collect certain information using automated tools or tracking technologies. Tracking technologies allow us to improve the Aria Website. The types of information we collect automatically when you use the Aria Website may include IP addresses, device identifiers, device advertising identifiers, mobile network, the device’s phone number, operating system details, language preferences, referring URLs, length of visits, anonymous traffic data, and pages viewed.

We may combine certain automatically-collected information with other information we obtain about you, which may include data we obtain from third parties.

We or our service providers may collect Personal Information about your online activities over time and across different online services when you use the Aria Website. More information about how specific providers of tracking technologies use Personal Information is discussed below in the “Analytics” section.


We may obtain information from other sources and combine that with information we collect through the Aria Website. For example, we may collect Personal Information from our commerce partner. The categories of information we collect from other sources include:

Identifiers, such as your name, phone number, shipping address, and email address.


The Aria Website may allow you to engage with social media services, such as LinkedIn, Facebook and Instagram (“Social Networks”), and widgets such as a “Share this” button or Social Media timeline that run on our Website or which link from Social Networks to our Website (“Social Functions”). These Social Functions may access, collect, and integrate with your Social Network accounts and information. For example, these Social Functions may collect your IP address, identify which page you are visiting on our website, or set a cookie. If you choose to use these Social Functions, you may be sharing certain Social Network profile elements with us, including your name, birthday (month/day), comments, contacts, email address, or photos. This sharing is subject to each Social Network’s own privacy policy and terms of use. We do not control those Social Networks or your profiles on those services. Additionally, from time to time, we may post Aria Social Media content on Social Networks, or may invite the public to interact with Aria Social Media (for example, through the use of a certain hashtag). You agree that if you interact with Aria Social Media, you give us permission to use that interaction in further Aria Social Media on the same Social Network (for example, by replying to your post, or reposting it on Aria Social Media). We will not use your interactions with Aria Social Media in other Social Networks or for other purposes outside of Social Media, without your consent.

Statement regarding the California Consumer Privacy Act of 2018 (“CCPA”)

When you initially provide us with Personal Information through our Website, we treat this Personal Information as covered by the California Consumer Privacy Act of 2018, as amended, and its associated regulations (“CCPA”). We will continue to do so until and unless we learn that this information is your protected health information (“PHI”) subject to the privacy, security, and breach notification rules under the Health Insurance Portability and Accountability Act (“HIPAA”), at which point we will treat it as HIPAA-covered PHI.

When Personal Information is subject to the CCPA the following disclosures apply, as do the rights under the Your California Privacy Rights section below:

We collect the following categories of Personal Information:

  • (A) Identifiers (ex. real name, alias, postal address, unique identifiers, online identifiers, internet protocol (“IP”) address, email address, account name, social security number, driver’s license number, passport number, or other similar identifiers.
  •  (B) Categories of Personal Information described in subdivision (e) of Section 1798.80 (Identifiable information contained in Customer Records).
  • (C) Characteristics of protected classifications under California or federal law.
  • (D) Commercial information, including records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.
  • (E) Internet or other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding a consumer’s interaction with an internet website, application or advertisement.
  • (F) Professional or employment related information.
  • (G) Inferences drawn from any of the information identified in this subdivision to create a profile about a reflection of the consumer’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

Use of Personal Information

We may use Personal Information we obtain through the Aria Website for various purposes, including to:

  • Provide and maintain the Aria Website
  • Notify you about changes to the Aria Website
  • Allow you to participate in interactive features of the Aria Website when you choose to do so
  • Provide customer support
  • Gather analysis or valuable information so that we can improve the Aria Website
  • Monitor the usage of the Aria Website
  • Detect, prevent and address technical issues
  • Assist with our marketing purposes, such as providing you with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or inquired about, or for more general purposes, such as identifying other potential customers that are similar to you, unless you have opted not to participate in such activities

Disclosure of Data

We may share Personal Information for the purposes described below.


We may share Personal Information with service providers, who will process it on behalf of us for the purposes described in this Privacy Policy and our Terms of Use (“Service Providers”). Service Providers include, but are not limited to, IT service providers, e-commerce platform hosting services, banks, credit card companies, brokers, suppliers of Durable Medical Equipment, shipping and logistics providers, training providers, survey service providers, investigators, and data hosting providers and custodians.

We are a wholly-owned subsidiary of ResMed, Inc. To facilitate our business operations, and to support the services that we provide, including the Aria Website, we may also share Personal Information with ResMed, Inc. or other companies that are members of the ResMed group.

These Service Providers have access to your Personal Information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.


We may use Service Providers to monitor and analyze the use of the Aria Website.


Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of the Aria Website. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network.

Aria Health uses remarketing services to advertise on third party websites to you after you visited the Aria Website. We and our third-party vendors may use Personal Information including information gathered from cookies to inform, optimize, and serve ads based on your past visits to the Aria Website.


Google Ads (AdWords) remarketing service is provided by Google Inc.

We may provide paid products and/or services within the Aria Website. To support this activity we use service providers for payment processing (e.g. payment processors).

Information we provide directly to our payment processors is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information.

Your Choices

If you do not wish to receive marketing emails from us or do not otherwise want your information to be used for marketing purposes, you can opt out by following the instructions provided in the marketing emails, or by otherwise contacting us at Opting out of marketing will not affect our administrative emails to you (e.g., emails about your transactions or policy changes).

If you no longer want to provide us information through the Aria App, you may uninstall the Aria App from your device.

Do Not Track Signals

Some web browsers or smartphones have the ability to set “Do Not Track” requests to block user activity from being tracked across web pages or devices. The Aria Website does not recognize “Do Not Track” browser signals.

Your (California) Privacy Rights

You may make certain requests regarding our use of your Personal Information by using a privacy rights request portal where available, by emailing us at, or by calling 1-866-647-0691. If you are a resident of the State of California, and our handling of your Personal Information falls within the scope of the CCPA and not HIPAA, some of these requests may be governed by CCPA. If you are not a California resident, or a response to any given request is not required by CCPA or other applicable law, you acknowledge that we are under no obligation to provide a specific response to any such request. However, we will make commercially reasonable efforts to respond to any request we receive, subject to applicable laws. For your protection, we may need to verify your identity before acting on your request.

The CCPA defines “sale” very broadly, which may mean our use of third-party cookies for advertising and retargeting purposes is considered a sale of your Personal Information. While we do not sell your Personal Information in the traditional sense, we may nonetheless be considered as “selling” under the CCPA. For these purposes, in the past 12-months we have “sold” identifiers (i.e., cookie IDs) and internet or other electronic network activity information (i.e., information regarding your interaction with our Website or an advertisement) to third parties including advertising providers. We do not knowingly sell the Personal Information of individuals under 16.

To the extent our handling of your Personal Information is subject to the CCPA, you have the following rights:

  • Right to Know and Access. You can request a copy of the Personal Information we have about you, as well as information about our handling of your Personal Information. We will provide a copy or a summary of your information, usually within 45 days of your request. We may charge a reasonable, cost-based fee when permitted.
  • Right to Correct. You can ask us to correct Personal Information about you that you think is incorrect or incomplete. In your request, please make clear what Personal Information you would like to have changed. We may say “no” to your request, but we’ll tell you why in writing within 45 days.
  • Right to Opt-Out of Sale. You have the right to ask us not to sell your Personal Information to third-parties. This opt-out right does not apply to Personal Information that we share with service providers involved in the operation of the Website.
  • Right to request confidential communications. Within reason, we will act upon requests to contact you in a specific way (for example, home or office phone) or to send mail to a different address.
